Platform Disclaimer

Effective Date: 1 March 2025

Pulse World (“Pulse”, “We”, “Our”, “Us”) provides access to its Platform and Services on an “as is” and “as available” basis. By using our Platform, you (“User”) acknowledge and agree to the full scope of disclaimers outlined below. This disclaimer forms part of the legal framework that governs your use of the Platform.

NO GUARANTEE OF ACCESS OR AVAILABILITY

There may be instances where we are temporarily or permanently unable to provide access to the Platform or Services due to maintenance, upgrades, cyber threats, regulatory changes, or unforeseen disruptions. Users acknowledge that such unavailability may occur without prior notice and without any liability on our part.

NO WARRANTIES

Pulse explicitly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;

  • Any assurance that the Platform will meet your specific expectations or performance goals;

  • Any warranties that results obtained through the Platform will be accurate, timely, reliable, or uninterrupted.

Users accept that they engage with the Platform entirely at their own risk.

OPERATIONAL LIMITATIONS

Pulse does not warrant or guarantee:

i. That the Platform or Services will function continuously, without error, or be free from downtime or service interruption; ii. That any bugs, errors, or technical defects will be detected or corrected in a timely manner; iii. That the Platform is free from malware, viruses, or other security vulnerabilities; iv. That your personal data, account credentials, or digital assets will remain completely secure, retrievable, or protected from corruption or loss; v. That transactions performed on the Platform will yield accurate or desired outcomes; or vi. That the functionality of the Platform will meet your operational or business requirements.

NO CONTROL OVER SMART CONTRACT EXECUTION

Pulse may develop and deploy smart contracts on blockchain networks as part of its Services. These smart contracts are autonomous, self-executing programs that operate independently once deployed. Pulse does not retain control over their execution, and cannot intervene, reverse, or halt outcomes once a transaction has been broadcast to the network.

Users accept that smart contracts carry inherent risks and are solely responsible for their interaction with them.

COMMUNITY-DRIVEN GOVERNANCE AND UPGRADES

Pulse’s protocol infrastructure and certain components of the XPL Token economy may be governed through decentralized, community-driven frameworks. Upgrades and parameter changes may be proposed and voted on by eligible token holders. Pulse does not guarantee any specific future direction, support, or development outcome.

No developer, contributor, or affiliate of Pulse shall be held liable for any direct or indirect damage, including but not limited to loss of access, downtime, malfunction, data loss, or financial losses resulting from decisions taken by the community or bugs within community-governed systems.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Pulse and its affiliates, directors, employees, developers, and service providers shall not be liable for any damages of any kind arising from or relating to your use, inability to use, or interaction with other users or smart contracts through the Platform, including but not limited to:

  • Direct, indirect, incidental, or consequential damages;

  • Loss of revenue, profits, data, or digital assets;

  • Security breaches, hacks, or compromised wallets;

  • Regulatory restrictions or changes in legal status.
